The use of this website means that you are agreeing to accept the terms and conditions of use. These terms and conditions can be printed out by selecting print from the file menu of your browser.

These terms and conditions apply to the website www.hkjewellery.co.uk, its contents and products, they do not apply to other websites owned or run by Harriet Kelsall Jewellery Design Ltd.

By using the website you confirm that you are at least 18 years old, or, if you are under 18, that you are accessing the website with the consent of your parent or guardian.

You may not copy, reproduce, distribute, republish, download, display, post or transmit any part of the website without written consent from us. Images or content from this website may be printed out for legitimate use relating to the company.

The images on the site are for informational purposes only and are automatically protected under UK copyright law.

You shall not use the website in any way that will damage it or interrupt its provision. You shall not use the website to transmit or post any computer viruses. We cannot guarantee that the website is free from computer viruses, and you should take your own precautions in this respect.

We will try to make sure that the website is always available. However, this is not always possible, and we are not liable if the website is unavailable.

Very occasionally information displayed on our site may be incorrect due to system errors. We will of course make every effort to avoid errors but if they do occur we will not honour inaccurate or erroneous prices.

DESIGNS AND COPYRIGHT

All of the designs displayed on www.hkjewellery.co.uk are the company’s intellectual property and are automatically protected under design right. This means that the use of these designs for any purpose without our written permission would be an infringement of UK Patent Law.

Any infringement of design right or copyright (such as copying by other manufacturers or retailers) would entitle us to take civil action in court with a view to seeking damages.

The term ‘unique’ or ‘unique design’ when applied to a design or product on this website means that the design has at least one difference to any other design on this website. Although we would never copy other people’s work, we cannot be held responsible for copies of our unique designs by other people known or unknown to us.

LIABILITY

Under no circumstances shall Harriet Kelsall Jewellery Design Ltd be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or otherwise, even if we have been advised of the possibility of such damages.

PAYMENTS

Our prices may be subject to change without notice.

US Dollar and Euro prices quoted are for informational purposes only and are very approximate. Your credit card company will convert our Sterling prices into your local currency using their own exchange rate at the time of purchase.

Gift tokens are not redeemable for cash and are not transferable. The balance of a gift token must be used in one transaction. Harriet Kelsall Jewellery Design Ltd is not responsible for the loss of stolen gift tokens.

Gift tokens are redeemable only within our shops.

BANK TRANSFERS

If you decide to make payment via bank transfer you must accept any bank charges involved. Please ensure your bank does not deduct any fee from the amount transferred.

Our bank will not apply any charges for an international transfer.

FINANCE OPTIONS

0% finance is provided subject to eligibility with a minimum spend of £2,500.

Harriet Kelsall Jewellery Design Ltd is not a lender. Credit is subject to status and affordability, and is provided by Novuna Personal Finance, a division of Mitsubishi HC Capital (UK) PLC, authorised and regulated by the Financial Conduct Authority.

Terms offered are 6 or 9 months and a deposit is required of 20% for ready to wear items and 50% for commissioned jewellery.

DELIVERY AND COLLECTION

Shipments dispatched remain our responsibility until received by the recipient. Harriet Kelsall Jewellery Design Ltd is not responsible for jewellery where delivery has been attempted but no signature was obtained by the delivery company.

Damaged or tampered shipments must have the word ‘DAMAGED’ written by the receiving person on the delivery agent’s paperwork. Failure to do this will result in the shipment becoming uninsured and Harriet Kelsall Jewellery Design Ltd. cannot accept responsibility for this.

Jewellery shipped abroad may be liable to tax or duty charges applied by the recipient’s country’s customs. This is out of Harriet Kelsall Jewellery Design Ltd.’s control and is something we cannot accept responsibility for.

Jewellery returned remains the responsibility of the customer until received back by Harriet Kelsall Jewellery Design Ltd together with the appropriate paperwork and packaging (see delivery information for more information).

Jewellery is not guaranteed for delivery on Saturday unless specially arranged and Harriet Kelsall Jewellery Design Ltd is not responsible for any loss or claim resulting from this fact.

All commission balances must be paid within 1 month of completion. All commissions must be collected/delivered within 3 months of completion. After this point, we reserve the right to charge a storage fee.

RETURNS

Due to UK health and safety legislation, earrings cannot be returned.

Purchases made in either of our shops can be exchanged or returned for a voucher of the same value. Please see our purchasing and delivery information page.

Our returns policies do not affect your statutory rights.

CARE FOR YOUR JEWELLERY

We provide comprehensive information as to how to care for your jewellery. We cannot accept responsibility for problems with your jewellery if this advice has not been exactly followed.

RING SIZES

The UK to US ring size conversion charts are provided for informational purposes and are accurate to approximately within 1/4 of a finger size only. We do not accept responsibility for the inaccurate use of this information.

We will either take your ring size in person (or explain how to use our ring sizer hire service) using industry standard Wheatsheaf Ring Sizers of either narrow or wide size. We will offer any sizing advice in good faith however the final responsibility of finger size choice lies with the customer as the fit is always a matter of personal preference. Once the customer’s finger size has been agreed with Harriet Kelsall Jewellery Design Ltd., this decision is binding and the customer will be charged for any subsequent changes of ring size.

DIAMONDS, GEMSTONES & METAL

Harriet Kelsall Jewellery Design Ltd only purchases diamonds from respectable dealers that adhere strictly to the Kimberley Process and every attempt is always made to ensure that diamonds are not sourced from countries that use the money to fund conflicts.

Diamond carat weights stated are within 0.05 carats of the exact weight to comply with FTC regulations.

Any geographical or origin provenance claims made in respect of gemstones and metal are made in good faith based on written statements from our suppliers and not laboratory testing. Our membership of the Responsible Jewellery Council requires that we have robust procedures and systems in place to verify these claims – more information is available on request.

Some coloured gemstones are heat treated to improve their colour and / or clarity. Aquamarine, citrine, tanzanite, and blue or clear zircon are routinely heat treated whilst agate, amber, carnelian, morganite, ruby, sapphire, smoky quartz, tourmaline and turquoise are commonly heat treated. Pale coloured pearls are likely to be bleached. It should be assumed that these gemstones supplied by us have been treated in this way unless we specify otherwise. Clear topaz is routinely treated with a small amount of irradiation and is then heated to give it a permanent blue colour that runs throughout the stone and opal is commonly treated with waxes or oils to stabilise the gemstone. Any further treatments are individually disclosed.

Opals can be made into a doublet or a triplet to add thickness, strength and weight to pieces otherwise thin or brittle. A section of the opal is backed with epoxy resin creating a doublet, and then sometimes topped with resin to create a triplet. If we have used a triplet or a doublet in your jewellery it will have been discussed with you.

Turquoise/amber/lapiz can be cut into interesting shapes. Beads can be a composite material which is a treatment that involves combining the ground or sections of gemstone which are then bonded with resin to create a smooth and even colour or for an interesting pattern or sometimes to improve durability.

Goldstone and Sunstone are a man-made glass material. They are not a naturally occurring gemstone.

GENERAL

We reserve the right to change these Terms & Conditions of use from time to time. If this happens, we will notify you by posting the new Terms & Conditions of use on the website. If you do not wish to be governed by the revised Terms & Conditions of use, please stop using the website.

These Terms & Conditions of use are governed by the law of England and you and we agree to use the English courts if there is any dispute between us.

If any part of these Terms & Conditions of use is found to be invalid by law, the rest of them remain valid and enforceable.

COMPLAINTS PROCEDURE

At Harriet Kelsall Jewellery Design Ltd., we pride ourselves on giving you a great design experience, excellent craftsmanship and personal service. We understand things can go wrong occasionally and so we will strive to listen and resolve any concerns you may have.

Should you wish to raise a concern, in the first instance, contact your designer in person, by letter, telephone or by email.  They will, of course, be familiar with your commission and will be happy to assist in any way they can. Alternatively, you can contact us by email at [email protected] stating your areas of dissatisfaction/complaint and which design studio it relates to.

We will respond initially within 48 hours confirming receipt of your complaint, taking note to record all of the details clearly.

We will investigate your complaint, inform you of our findings and, where we are at fault, try both to put things right and to review our process and procedures to avoid a similar situation.

The designer will work with you to resolve the issue and explain the solution.  However, if you are still dissatisfied, it will be referred to the Head of Design or a member of our senior management team. They will review the complaint and work with you to resolve the issue.

In most instances a quick resolution can be found, however, if the investigation takes longer then a final response letter/ email confirmation will be sent to you within 4 weeks of initial receipt.

It is really important to us that you are completely satisfied with our work however should our procedure still not resolve your complaint please be assured that as part of the National Association of Jewellers, you are free to contact them regarding your complaint with us.
